CANCELLATION/RESCHEDULING POLICY

• Due to cost of supplies, labor and other fees associated with scheduling each project there is no refund for any deposits.
• Rescheduling or Canceling appointment within 30 days of the project appointment will result in no extra fines. Rescheduling or Canceling within 14 days of the project appointment will result in a 10% added charge.
• Rescheduling or Canceling within 7 days of the project appointment will result in a 25% added charge.

• Bad deposit checks will automatically be considered as a cancellation unless the check is repaid and all fees repaid and will then be treated as a reschedule.

LEGAL & TECHNICAL EXPLANATIONS, LIMITATIONS, and GUARANTEES:

• A comprehensive, formal list of legal & technical limitations, as well as given or implied guarantees from Stone Buff, LLC to the Customer has been delivered to the Customer, regardless of weather or NOT the Contract was formally entered at that time.
• By signing the Contract, the Customer automatically acknowledges the receipt of this official list of legal and technical explanations, limitations, guarantees & has read & understands them.

• The Customer also agrees that such official list of legal & technical explanations, limitations, guarantees shall become part of the Contract once this Contract is entered by being signed by both parties. 

• Customer acknowledges that they must allow 72 hours cure time before applying any moisture to the surface after restoration.

• Stone Buff, LLC gives to the Customer only the express warranty that Stone Buff, LLC will perform its scope of work in a skilled and workmanlike manner in accordance with its industry standards. EXCEPT for the aforesaid express warranty with a paid maintenance program, there are no other warranties expressed or implied, including the warranties of merchantability & fitness for a particular purpose.

• Stone Buff, LLC will NOT be liable to buyer for loss of profits, or, for any claim against a buyer by any other party, or for any special indirect, incidental or consequential damages of any type whether based in tort, Contract or other legal theory, even if Stone Buff, LLC has been advised of the possibility of such damages.

PAYMENT AND TERMS:

• A non-refundable 25% deposit is required to schedule your project and 25% non-refundable deposit is required to begin the project on the arrival of the 1st day of your project.  The remaining balance is due upon completion. 
• The work identified by this proposal is for the complete project as we estimated.  Items not addressed are not included.  Work will not be scheduled until a signed Proposal is received along with deposit, if required. Price is based on work performed, not amount of time.

• Acceptance of our Contract: If a Contract is not signed the use of our services or placing a deposit shall constitute a verbal acceptance of this contract and all of its terms.

• Failure to respect these terms will entitle Stone Buff, LLC to charge a penalty of twenty-five percent (25.0% APR) of the outstanding balance until the balance is paid in full.
• Checks returned for any reason are subject to a $40.00 returned check fee and any additional bank charges incurred will be applied to the outstanding balance and subject to the above penalty of twenty-five percent (25.0% APR)until the balance is paid in full.
• Failure to pay the balance on time can and may result in collection fees, attorney fees, court costs and a possible lien filed against the property.
• All fees will be the financial responsibility of the customer.
• The prices in this Contract, specifications & conditions are satisfactory & are hereby accepted. 
• A credit application must be processed for Customer's requesting terms longer than 15 days.

INSURANCE:

• All  Stone Buff, LLC employees are covered by $2,000,000 comprehensive general liability insurance, $10,000 bond and have full Worker's Compensation coverage.  It will take approximately 5-7 working days to process a Certificate of Insurance.  Please note that the owners of Stone Buff, LLC are not employees and are not required nor covered any Workman's Compensation.  Workman's Compensation covers Stone Buff, LLC not the customer.

Variances we did not account for: Great care is always taken on our bid to ensure no surprises.  Unfortunately, what we cannot see, we cannot account for. Issues such as: Uneven stairs, sub-floor issues, squeaks in sub-floor we are unaware of, height differences in transitions, surprise underlayments under carpet or linoleum that might be removed, floors that are not level,, unleveled thin-set, wrong products used prior to Stone Buff, LLC’s arrival, hallow areas, humps in floors cannot always be made perfect (only so much can be done), mold issues, gas lines that are not placed 2 in. under sub-floor to industry standards, water lines for ice maker placed too close to wall board, clogged shower pans, water that is trapped for any reason or any other unseen pre-existing issue.

 

Stone Buff, LLC will work with you, to help in any way we can to ensure any extra costs due to variance issues will be reasonable. No action will be taken until you, the Customer, are aware of all issues.

 

NOTE: All stone, granite, marble, Travertine, slate, etc. are products of natural stone. Natural stone is a product of nature. Natural color and veining will vary from one tile to another and from one area to another. Within each piece, because it is a natural product, it is termed an exceptional product, i.e. an exception to the norm., in the industry.

 

Stone Buff, LLC typically requires up to a 50% of the project total as a security deposit in order to make an appointment for your project.  This deposit is non-refundable.

 

In some cases, the product you choose from could be moderately different.  If you wish, a sample can be provided to you prior to your project for final approval.

 

Stone Buff, LLC cannot be held accountable for variances in a natural or synthetic product. Be confident we will do everything possible to achieve the essence of the product you choose from.

 

NOTE: All granite, marble and grout should be sealed to avoid stains. This is usually included in our estimate unless the customer gives a written request for us not to seal the surfaces and/or grout.

 

Ceramic and porcelain floor tiles will tend to have slight to average shade variation in tile. This is the design and intent in most cases to add to the beauty of your new floor. The selection that you choose from will be the essence captured in your surface.
